Philip Bruner is an accomplished arbitrator, mediator and resolver of disputes and claims arising out of construction, engineering, infrastructure and development projects in and outside of the United States. Such disputes and claims frequently arise between two or more national or international project participants, such as government agencies, private owners, contractors, subcontractors, design professionals, sureties, construction lenders, material and equipment manufacturers and suppliers, insurers, real estate developers, public procurement and private contracting representatives, building code and regulation enforcement officials, field inspectors and project and construction managers. He is the Director of JAMS Global Engineering and Construction panel of neutrals, which provides innovative and cost-effective dispute resolution services to the U.S. and international construction industry. BackgroundAs an arbitrator, Mr. Bruner has served as sole arbitrator deciding aggregate claims in dispute exceeding $120,000,000 in a single arbitration, and has chaired or served on numerous tripartite arbitration panels deciding aggregate claims of hundreds of millions more. He has chaired Appellate Arbitration Tribunals convened under JAMS Optional Arbitration Appeal Procedure that exercised the same scope of review jurisdiction as a United States Court of Appeals. He has chaired a Dispute Review Board that issued non-binding advisory decisions on claims arising on a quarter-billion dollar interstate highway project.
As a mediator, Mr. Bruner has mediated engineering, construction, infrastructure and other commercial disputes involving as many as twenty parties seeking recoveries aggregating over $150,000,000 in one mediation. His engineering, construction, infrastructure mediations have involved many large projects in such locations as New York City, upstate New York, Florida, Pennsylvania, Illinois, Massachusetts, Michigan, Minnesota, Tennessee, Texas, Colorado, Oklahoma, North Dakota, and Europe.
As a practicing lawyer for over 40 years prior to becoming a full-time neutral, Mr. Bruner concentrated on construction, engineering, and infrastructure litigation and was lead counsel in nearly 100 arbitrations and dozens of litigated cases venued in over 30 states. He also mediated or participated in mediation of countless cases. Parties come from across the spectrum of construction industry participants, including public and private owners, contractors, subcontractors, specialty contractors, architects, engineers (civil, structural, mechanical, electrical, geotechnical, hydrological), sureties, insurers, material manufacturers, material suppliers, equipment suppliers, construction lenders, and construction accountants.
